Confirm that trademark is the right category
Trademark reports usually concern a word mark, logo, slogan, or trade dress used in a way that may imply source, sponsorship, or affiliation. A copied photograph or product description is usually a copyright question instead. A customer who simply did not receive an order may need the fraud or order-support route. Classifying the conduct before drafting keeps the report focused.
Prepare the rights information
- Your name, company, authority to act, and reliable contact details.
- Registration jurisdiction, registration number, classes, and a public registry link when the mark is registered.
- Your official storefront and examples showing how the brand identifier is legitimately used.
- The suspected store's exact home, product, collection, checkout, or social-ad landing URLs where the identifier appears.
Describe the use, not just the similarity
Pair each suspected URL with a short factual note: the logo appears in the header, the registered name appears in the page title, or the store claims to be an authorized outlet. Add capture times and screenshots. If you have actual confusion, describe the event and redact customer personal data. Avoid conclusory language that the evidence cannot support.
Submit and retain the record
Use Shopify's official merchant-report tool and select the trademark or trade-dress path that matches the facts. Save the form version, submission date, confirmation, case number, attachments, and any request for more information. Review the declaration carefully before submitting because it is your statement, not CopyWitness's.
Common reasons a report stalls
Missing registration details, screenshots without source URLs, reporting a whole domain when only two pages contain the mark, or failing to explain your authority can force avoidable follow-up. A one-row-per-URL comparison is usually easier to review than a large unsorted archive.
